– The government thus aims to eliminate the administrative barriers that, according to the Ministry of Health, have been denounced by various organizations and which hinder access to public healthcare for undocumented migrants residing in Spain. The regulation expands upon the provisions of the 2003 Healthcare Cohesion Law and introduces a “uniform” procedure throughout the country to recognize the right to healthcare for foreigners without a residence permit in Spain. “This regulation seeks to guarantee equity and prevent inequalities for this group, allowing for better disease control at the primary care level and a more efficient use of public resources,” emphasizes the department headed by Mónica García .
– With the aim of reducing all the bureaucracy involved in this process, access to this right will only require a sworn statement, in which the applicant affirms that they do not have any other type of health insurance coverage, that they cannot transfer this right from another country, and that there is no third party obligated to pay for their care. “We are making access to healthcare the default option and reaffirming a very simple principle: public healthcare is a right of everyone living in our country,” García celebrated, while also advocating for universal access to healthcare “at a time when the far right, racism, and exclusionary policies are gaining ground in many places.”
– To prove habitual residence, a social services registration document will be requested, although the Government contemplates exceptions in cases where such documentation cannot be provided: certificates of schooling or enrollment in public centers; reports from social services or certificates of visitor records; electricity, gas, water, telephone or Internet bills in your name; or registration certificates and consular registration documents.
– Upon submitting the application, the migrant will receive a provisional document granting immediate access to publicly funded healthcare while their case is being processed. This document will be valid in any autonomous community. A three-month period will then begin during which the decision will be communicated. If no response is received within this time, the application will be considered approved and will remain in effect until coverage is obtained through other means.
