– Today, the European Commission has adopted the EU KIDS Act to enhance the online safety of children throughout the Union.

IMMIGRATION IN SPAIN
National Court backtracks and rejects halting the migrant camp in the Port of Ceuta– National Government uses its control over State-owned port to override the objections of the Ceuta authorities, the Port’s own governing board and even the national Interior Ministry: {Trans, summary}
– The Audiencia Nacional has reversed its earlier decision to halt the proposed migrant camp in Ceuta’s port, refusing the Sindicato Unificado de Policía (SUP) request to keep the project suspended. The earlier ruling had stopped the installation temporarily and required the Transport Ministry to produce the authorisation and supporting documentation. It also raised questions because the Government’s authorisation did not appear to have been published in the BOE, leaving uncertainty over the formal basis for the project.
– Despite those unresolved questions, the court has now allowed the camp to proceed while the wider legal dispute continues. The National Court considers that there are “general interest” reasons that justify the authorization requested by the Government to set up the camp. This is particularly significant because the SUP has warned of fire and evacuation risks and the camp’s proximity to fuel facilities and other strategic infrastructure. Those risks potentially affect not only migrants housed at the site, but also port workers, police, emergency services and members of the public in the surrounding area.
– The court has now allowed the project to proceed without itself establishing that the proposed operation has all the necessary safety arrangements. Instead, it has left those arrangements to the Interior Ministry, which is responsible for determining the security conditions for police officers, migrants and other personnel at the site. This is particularly significant because Interior had already identified the camp as creating an “increase in risks” to the port, classified as critical and sensitive infrastructure, and had ordered temporary additional maritime security measures.
– {Editor’s comment– The Paradox: The same national Government that has authorised the camp includes a Interior Ministry that has formally declared significant risks arising from it. Interior itself formally said the camp would increase risks to the port, because putting a large number of people into the port would alter normal operations and increase risks involving access control, restricted areas, critical infrastructure (like the nearby water desalination plant & fuel storage tanks), and maritime and port operations. It consequently raised the port’s maritime protection level to Level 2.
– The Government is nevertheless proceeding with the new migrant camp at the Port despite the warnings, with Interior now responsible for determining and implementing the additional security arrangements they had identified as insufficient. This will take time and allow serious risks to continue until Interior gets caught up with these new responsibilities.
– The result is a bureaucratic maze in which responsibility is divided between different national ministries, the Port Authority, Ceuta’s authorities and the courts. What might appear to be a straightforward question of whether the camp is appropriate for the port has instead become a series of overlapping administrative and legal decisions, with conflicts regarding who has authority over what, while the risky project itself moves forward.
– It gets clearer everyday that it is more important for the Sanchez admin to accommodate illegal aliens and the Moroccan leadership than protect Ceuta residents & infrastructure. The national Government is proceeding with a project despite its own Interior Ministry formally acknowledging that the camp increases risks to a critical and sensitive port infrastructure.
