She’s just over three months old now and is a very happy and well behaved girl.
Shes housetrained, walks well on a lead and knows basic commands.
Gets on well with cats, dogs, and humans of all ages.

UK Pensions & Tax

Following today’s post by Adrian – if he is a Spanish resident, then the difference is  that both his state retirement pension and his civil service pension have now to be declared in Spain (he should already have been declaring and paying tax if necessary on his state pension here, not the UK) starting from 2015. This means it should already have been done in the declaration done earlier this year. You are not taxed on the civil service one, as it was taxed in the UK under the double taxation agreement, but it is used to calculate your total income and therefore your tax band. This could make a huge difference to the tax you pay, but it can’t be avoided.

If he didn’t do it this year, I would suggest he consults a gestor asap, as they will catch up with him and then fine for non payment on top of it. If he’s not a Spanish resident, then I don’t know the position, but no doubt someone else will. His wife should also have been declaring her state retirement pension here too, if only to prove to the Inland Revenue that she is doing so, even if she is due to be taxed on it. In these high tech days, there is more and more communication between the tax authorities of different countries. They may also be better off doing a joint declaration then separately, but Hacienda will tell you each year which is best for you when they calculate it.

Under previous and existing rules of the UK/Spain bilateral treaty certain pensions eg civil service, military are not taxable in Spain as long as tax is paid in the UK. The remainder of income is to be taxed in Spain.
This remainder was assessed for tax in its own right, exclusive of the untaxed amount.
Now it must be taxed as a portion of the whole. Effectively adding in the untaxed portion takes the amount to be taxed into a higher band. So it can be seen that this move is a subtle revenue raiser.

Reply to Adrian on taxing civil service pensions.

You are correct Adrian, assuming you live for more than 6 months of the year in Spain so should pay tax here.  Since 2015 you must declare your civil service pension in Spain although it remains taxed in the UK and is not taxed here.  Prior to that although that pension  was not taxable in Spain the rest of your income, including your state pension,  was.  Effectively you got two tax allowances, one in each country.    Now you must declare everything and your civil service pension will ‘use up’ you tax allowance in Spain, so your state pension and other income may be taxed more.  See a good Gestor.

I am an ex-civil servant in receipt of a small pension and from 2015

(to be declared by 30 June 2016) it is now taken into account when calculating any tax that may be due in Spain.

However, as residents here (ie in Spain 183 days or more in one calendar year, not necessarily consecutively) I understood that we are obliged to complete residents’ tax returns even though (up to 2015) we were not liable to pay tax here.( I had to pay tax here but as I earn well below the UK tax threshold I unfortunately cannot set off any UK tax paid against Spanish tax due under the double taxation rules.)     Barbara W

Regarding the enquiry re tax rule changes for expats there has always been a requirement for British residents of Spain to file an annual tax return in Spain.

I am in a similar situation to the enquirer inasmuch as I receive a Police pension which is taxed at source and there is no way around that.  Under normal circumstances the DWP pension would be simply added to that for tax purposes.

However, there is an arrangement where the DWP element of your pension can be transferred to Spain for tax purposes which, in effect, means that you do not pay tax on it.

In order to do this it is necessary to submit an HMRC Spain – Individual form (it can be downloaded from the HMRC website and is 22 pages long!).  It has to be completed in English and Spanish and has to be accompanied by a form Residencia Fiscal en Espana – Convenio available from the Agencia Tributaria.

You will need a gestor or abogado to complete your first tax return (it has to be done by June each year in respect of the previous year’s tax liability) and he/she will be able to obtain the Residencia Fiscal form.

It’s a bit of a pfaff but worth it!  Hope this helps.

In response to Adrian’s question about paying tax on his civil service pension, I have been in exactly that bracket and have been paying tax in Spain for many years including this year.
U.K. Government contributory pensions (civil servants, teachers etc) must pay the tax on that to HMRC in the UK. Tax on just about all other income, including retirement pensions, MUST be paid in Spain.
That means you need to get HMRC to separate the tax liability. Contact them and ask for the relevant forms.
Our taxes here are handled by Guillermo Alférez in Viñuela (tel. 629366058). Guillermo speaks good English and understands the system completely. He won’t charge you a fortune and may well save you more than his fee. There is parking outside his office.

Tax Rule Changes for UK Retirement Pensionistas ?

Hi Digamites

I am a Ex Civil Servant who is paid a pension in the UK which is taxed at source.

My wife and I also receive UK retiement pensions.

My pension is included in my total income and taxable in the UK-

My wife’s pension is not taxed.

I understand the Spanish authorities now want tax returns from Ex Pats under

a new law (2015) although there is no tax payable under the UK/Spamish Tax Treaty.

Is this Correct ?

Recommendation Needed–Vacuum Cleaner

I need a new vacuum cleaner and do not seem to have had much luck with others I have chosen in the past.  Can anyone recommend a good vacuum cleaner for laminate flooring, tiles and large rugs?  Has anyone got a Henry vacuum cleaner and if so what do you think of it as that is the one I have been recommended to buy.

and enlightening look at Miguel de Cervantes Saavedra,

the well-known author of Don Quixote.

Sue Harvey is my predecessor of the NHG and, as many know,

is an entertaining Speaker.

I should like to apologise to those who were unable to get in to the

Talk on 4th November.  Health and Safety regulations have limited

the number of attendees to 100. I have always suggested that you arrive early,

give your donation, choose your seat and then go for coffee and return.

It really is a case of “first come first served”.  Some months, the number of attendees

is around 70 or so.  This is due in part to subject matter and also,

the transient population.  It really goes against the grain for people not to be able to gain entry

so, once again, sincere apologies and please don’t give up on us !

What’s on- The Nerja Players

This coming Tuesday, 29th November, the Nerja Players are proud to present a rehearsed reading of the two act play, “And a Day”.  This play is special for us as it is the first play written by our own member, Arthur Honey.  Arthur says that he,

“Wrote my first play for the Nerja Players just for something to do.  I never expected it to be put on.  “And a Day” was written for a small cast as the Players were short of actors.  It combined my love of the theatre and history, setting it around WWI.  Social history has always been of more interest to me than kings and queens.  I don’t think of myself as a writer – I just try to write, telling the stories of the people that enter into my head.”

“And a Day” is a tale of romance and is set during the First World War and features best friends Dan and Willy, who work in the local factory,  and their respective girl-friends, Sally and Ann.  On the outbreak of war Dan and Willy are sent to the Front and the local factory is requisitioned to make munitions.  Sally is employed filling artillery shells and dreams of Dan’s return.  Ann, however, has a different vision of her future – but nobody knows what the future holds…..

It is directed by Peter Burch who says he is looking forward to working with Arthur in the future as well as with this production.

If you would like to watch this special rehearsed reading please come along on Tuesday 29th November 2016 to the Nerja Bridge Club premises, which are at the top of Avda Castilla Perez, Nerja, behind the blue double doors next to the Cafe Royal.  We meet at 6.30 for 7 pm.

Does anyone know of any shop that sells the plastic boxes of a biscuit selection for cheese? I am not talking about titchy little packets with 3 different biscuits in, but the big double layered box about 9″ square with lots of different ones. Using traditional equipment and methods as well as local organic ingredients, we will prepare a variety of Moroccan dishes. Through the dishes offered on the menu, we will be exploring the main ingredients and spices used in Moroccan cookery.

Vilostrada runs a fair trade Moroccan artisan craft shop and will add tastes from the north of Morocco and the desert.

The workshop starts at 10.30 and finishes at around 3 p.m. and includes all the ingredients, lunch at the beautiful mountain finca in the foothills of La Maroma mountain, and your folder of recipes to take home.  Cost 35 euros.

What’s on-Torrox Christmas Market

Dear Digame,

for the information of your followers here are details of the Torrox Christmas market.-

The market this year is being held in the two banqueting suites of the Horto Malaga restaurant in Torrox Costa on the main N340 road in front of Laguna beach.

The market is being held on the 7th through to the 11th December and officially opens on the 7th December at 5pm and goes on til 21.30 hours

The rest of the days 8th,9th,10th and 11th dec the market is on from 11 am til 21.30

We have 42 stalls with a wide variety of articles that would make lovely Christmas presents, including homemade Christmas decs, outside Christmas decs, decorative soaps,  goods from India, handbags, purses, belts homemade chocolates, Hams and cooked meats, decorative plates, crochet, jewellery, honey, craft beer but to name a few.

Outside there is a children’s play area and 3 exterior bars and of course buñuelos and roast chestnuts.

Santa will be on his throne from 11 am til 3 pm to receive children’s letters and to have his photo taken with the children (free of charge)then from 4.30 til 9.30pm one of the 3 kings will be present for the same purpose.

The Horto Malaga restaurant I am sure is doing a menu of the day as well.

Thanks to an article on Digame I started to go to Pilates classes at Pilates con Lorena in Torrox Pueblo, I have back problems and also arthritis and she is really helping me to overcome some of my problems.
Her classes are very reasonably priced and she provides all the equipment in a lovely studio designed for the classes, she is kind, caring and an excellent instructor, I would highly recommend her for just exercise or for people with problems where stretching and building strength can help. There are lots of classes at different times to suit everyone.

Recommendation –Motor Insurance

Having recently returned to the UK we motor insurance.  We did not realise how problematic this was going to be. Given our ‘mature’ years and having been out of the U.K for over 10 years most insurance companies did not want to know, especially with a Spanish non claims certificate!!  Our initial quote for motor insurance was £2880 .
Our saviour was our Mapfre Insurance agent in Velez Malaga Juan Porras Garcia.
Juan was always very good with both our motor and home insurance whilst we were in Spain and issued us with a no claims certificate to give to a UK insurer.  Eventually we found a company that would accept the NCD certificate, but that’s when our problems started.
Then they wanted an English translation, Juan provided this
Then they wanted an English translation including the Mapfre logo, seal and signature , Juan provided this.
Then they wanted an end date for the last renewal, on an English translation with the Mapfre logo, seal and signature , Juan provided this.
Then as the expiry date for the policy was next April that was not good enough and they then wanted a policy cancellation document in Spanish with an English translation bearing the Mapfre logo seal and signature , Juan provided it.
Now I have insurance .

To clarify any errors or doubts, Nerja Town Hall Foreigners Department informs of 2 different conferences in English:

Thursday 24th November at 11 am. at Nerja Caves Restaurant, “restaurante cueva de nerja” re. The participation of Foreign Associations in the Nerja Town Hall Budget of Expenses for 2017.

A conference in English to all foreign associations of Nerja explaining the possibility that associations have to participate and give their opinion on what they would consider necessary that the Nerja Town Hall Budget of Expenses for 2017 should have and on what items money should be spent. Drinks and snacks will be offered after the conference.

Friday 25th November at 11 am. at Nerja Town Hall Meeting Room on the 2nd floor re. Brexit and what British living in Spain should do. After the recent voting of the “Brexit”, Britain leaving the European Union, the Association “Brexpats in Spain” was created.

This Association from Mijas is 2 visiting areas with a high British population to inform of what you should do and conform with the Spanish regulations if the Brexit should take place.

For example, you should

be registered on the Padron,

take out Residency,

have a fixed doctor in Spain,

change your British driving licence to a Spanish one,

pay your taxes in Spain and possibly take out Spanish Nationality, which means learning some Spanish and also knowing about Spanish culture.

The aim of the Association Brexpats in Spain is that Town Halls get involved collaborating together with other towns, so things will be easier in a near future if the Brexit should take place. The conference will be at Nerja Town Hall meeting room “salon de plenos” on the second floor. It is important that you become a member of this Association.

A big thanks to DigameXtra because thanks to your previous site we found the details of El Llano parking in Almayate.
Also, we would like to recommend El Llano, at KM 267 on the N340 just before Almayate pueblo (coming from Málaga direction). They take caravans, boats and vehicles, from €30 a month. Open 365 days a year, from 9am on weekdays. Friendly family who speak English (they’re British) and Spanish.
Of course, I didn’t know they were British, so emailed them in Spanish and later spoke on the phone to them in Spanish!

Urgent ! New Home Needed 

Pussa

Recently I have been caring for a number of animals at my friends house in Nerja. Sadly, she has now been diagnosed with a terminal illness and will not

be able to return to Spain. She has to give up her beloved Pussa who she rescued 16 years ago.

The cat is definitely a campo cat, very independent and likes to ‘ hit the tiles ‘ at night time.

But she also likes a nice lap to sit on and is affectionate.

No signs of illness or aggression, even though she lives with 3 dogs!

She has been spayed, so there will be no additions to the family.

Although, I am not sure she could at her age!

Before I leave for

the city on Friday I really want to find her a nice home to live out her twilight years.

I am not associated with any charities, so there is no adoption fee to pay.

Santi Awaiting a New Home

Santi was born on June 1st and is the last of the litter to find a forever home.

We rescued his mother in May and discovered she was pregnant and she went on to have 6 pups.

2 have gone to Norway and 2 found homes locally – one from Digame.

We are keeping the mother and one pup but really can’t manage him also.

He is lovely and has had a good upbringing.

Can anyone give him a home? He is going to be a big dog!

Thefts from  Tourists –

Sorry to hear about the theft from a vehicle of all belongings. Thieves also target people who have just arrived in Spain. I have now heard of two cases where people have picked up a hire car and headed off on their holidays and who have then parked up somewhere en route to their destinations. And yes you guessed it, the car is broken into and their entire belongings stolen. It may be worth warning our friends and loved ones who might find themselves in this scenario to go directly to their destination without stopping or leaving the car unattended.  Nigel

Our friends arrived in Malaga last week, picked up their hired car and drove along the motorway towards Torrox ,stopping at El Ingenio, to pick up some things in Eroski. They parked in the main covered area. They were in the shop around midday for 20 minutes and came back to find that the back, side window had been smashed and their bags taken. Fortunately they had their passports, money, cards etc with them in the shop but lost all their clothes and toiletries. Not a good way to start their holiday. We reported it at the police station in Torre del Mar and have to say the policeman who dealt with us was very helpful and patient and spoke some English although we could speak to him in Spanish. I don’t think it helps that most of the hire car companies put their logo and sticker on the back window of their cars. Please tell your friends and families to be vigilant when visiting.  Avril

Siamese Cat Found in Torrox Pueblo 

This little cat has been found in the main plaza of Torrox Pueblo.  It was very thin and distressed but offered no resistance to being handled so we think it’s a lost pet.  It was also seen a few days ago near to the tile shop on Calle Almedina.  The cat has been checked out by a vet and is being cared for at the moment but the finder is returning to the UK in a few days.  If no-one recognises it or is willing to give it a home it will be set free near to where it was found.  It is very distinctive as it has a short / docked tail.

Everything Stolen…..

Our friends visited the Botanic gardens at Malaga, 3 days ago, en route to the Airport.

They spent about 2 hours there. On returning to the car in the Car Park, the back window had been smashed and ALL of their belongings including Passports, air tickets, and suitcases had GONE. Just a warning to others to beware! A lot of problems to sort out a d a horrible way to end a Holiday!

All formatting, pretty colours, bold, underlining, strange fonts etc are automatically removed.

Please – Don’t use all Block CAPITALS LIKE THIS or I may have to send it back for you to put into normal case (This is the way people normally write, with capital letters where appropriate – such as “I” and place names “Malaga”, makers’ names such as “Electrolux”,    days of the week “Monday”

You must include contact details, either an email address or a telephone number in the text. If you don’t I cannot publish it. Often I cannot “extract “your email address from the email, so repeat it please.

This is not a service for local companies to exploit.

The decision about what to publish is mine, if I don’t want to publish then I won’t.

If you want to send a picture please send it as an attachment to your email, in  JPEG format and try and keep the size down to around 200KB.

Please don’t send PDFs or Word documents.

Your email address must be quoted in this forrmat…I insert spaces within the address so that nasty software can’t steal their address for spam purposes – e,g, my address is correctly   janekirkspain@gmail,com

if it were a Contributor’s address I’d insert spaces thus –

janekirkspain @ gmail,com.

So all you do is remove those spaces before contacting a contributor.
