The year is nearly gone again. To say thank you to everybody for sharing Yoga with me in 2016,  i would like to invite you to my free Christmas Yoga on Friday, 23. of December 2016 at Shiva Center Torrox. Everybody welcome! We start at 20 h and will finish about 21.30 h.

The Yoga season 2017 will open with a special event on Sunday, 15. of January 2017 at the beautiful CASA EL MORISCO in Benajarafe. 2 h Yoga workshop for everybody (11.00 h to 13.00 h) open to english, spanish and german language. Costs: 15 € p.p.

On Monday 16. of January 2017 all open courses starts again.

Residency Tax Status

Further to my post relating to country of tax residency, Margaret’s posting earlier this week is quite correct, in that the circumstances I described only come into force when the tax residency status cannot be determined by the normal rules of the participating states, or there is a conflict between these rules, and I apologise for the confusion my post may have caused.

For the UK, these rules are fully described in the HMRC document RDR3 and can be found on their website. The full link is –

I have been unable to find the equivalent rules for Spain, but this may be due to limited understanding of Spanish.

The UK rules are quite complicated, but they show that the 183 day rule is still applicable. If you spend more than 183 days in the UK in any tax year then you are taxed, without exception, in the UK.

However, you can spend less time, (in some circumstances considerably less time), in the UK but still be considered a UK tax resident. In my particular circumstances, I am still considered a UK tax resident as long as I spend a minimum of 30 days in the UK in each tax year. When I spoke with HMRC on the subject they directed me to a particular web page where they have an interactive tool that you can complete. When all the necessary data has been entered, it gives you an immediate decision on your residency status for tax purposes. When I used this tool, it confirmed my tax status as above. Of course, this may be in conflict with the Spanish rules, but I am unsure how it would be put to the test.

This should open a form entitled, “Check your Residence Status”

Scroll down to “Information you may need” and click on Go to the Tax Residence Indicator and follow the document completion instructions.

Questions……

I have two queries I need answers for.

A friend told us she had been to the bank to “sign for” her pension and that everybody had to do the same.  I’ve never had to do this before, anybody know what this is about?

We part exchanged our car a year ago at the Hyundai dealership.  In the summer we received a tax bill for it. I referred it back to the dealers and heard no more.  Now we have received another notice.  Do we need to do anything or do we just ignore it? I have no intention of paying the tax (or any fines) on a car I don’t own.

Services Needed– CD disc changer not working!

We recently moved our Mini HiFi system from the lounge into the dining room and since then when we try to play any CDs we get “Mechan Error” message on the display.

Having googled the problem it appears moving a system can cause these problems sometimes.

We can open the door (there are no CDs stuck inside) but the actual disc player won’t turn at all.

We have a Sony model, 3 CD changer.  All other parts on the system, ie radio and tape decks, appear to be working OK.

Is there anyone out there in Digame land that used to (or still does) fix systems and could possibly help?

Pregnant dog which need a new home  

We live in a big community centre above Velez Malaga and we have always been surrounded by wandering dogs. Since summer there has been one particular dog which kept on coming and we kind of silently tolerated his presence. But now we found out that the dog got pregnant and we are facing a problem as for what to do now since there is no possibility for us to keep neither the big dog (the mum), nor the puppies.

But we don’t want to let the pregnant dog and the puppies die out of hunger and we are desperately looking for someone who could take care of the mum and her future puppies too. As I wrote, we are an international community centre and we are bound strictly by “no dogs” rules, so there is no chance the dog can stay here with us.

The mum is a big white female dog and we don’t know anything more about her since she’s the typical “perro del campo”.

Is there any chance you could take care of the dog or help us to find a proper home for her and her future puppies?

Nerja Foreigners Department informs that Residents Day for 2017 will be on Sunday 2nd April. In case of rain, it will be the following Sunday. Soon we will be contacting the associations that normally participate. You can confirm your participation at extranjeros@nerja.es This day is a tribute dedicated to foreigners who live or spend some time in the lovely town of Nerja. All foreign associations, clubs, magazines, press, radios, cultural groups, book writers, artists, animal protection or related with animals, medical centres, natural therapies or related with health, typical products of Nerja, the Axarquia or Malaga area, foreign or Spanish are welcome to participate in this event. If you wish to participate for the first time, please contact extranjeros @ nerja.es Residents Day will take place in the square Plaza de España behind the Town Hall. The stands will open to the public from 12 midday to 5 pm. There will be bars and a stage with music, dancing and entertainment during all day up to 5pm. Participating stands will have free parking at the Town Hall underground parking in Plaza de España.  Garbage tax, basura, 2nd semester 2016. Payment due up to 20th December This tax is for all owners of a property except for those living in the campo, field, who do not have garbage collection. Then take it to the bank for payment. To avoid surcharges for paying out of date, we advise you to make a bank order for all your local taxes at the Nerja Tax Office. Services – Sabadell Bank

Regarding the post about transferring from Madrid to Torrox – we were automatically moved from Lloyds to Sabadell when they were taken over, and to the Torrox branch. Took ages to get the new cheque book – and as Torre del Mar is better for us, I asked about transferring. I was told then (several years ago) that I would virtually have to close one account and reopen another to do this, and apply for a new cheque book etc (probably not so important now, as you rarely need cheques with online banking). As I rarely need to go to the branch, I didn’t bother – but Madrid is another matter! I have always found the staff at Torrox helpful, maybe it would be worth calling in there and explaining to them to find the best way of doing it.

Coming from The Mill, 1930 He was a painter not only of the mills al the industrial north-west but also perhaps the one of the great painters of the human condition himself – the TS Eliot of modern British Art and, perhaps we could even claim him as our very own van Gogh! About Michael Howard

Michael is President of Bolton NADFAS and until recently he was the Course Leader of the School of the History of Art and Design at the Manchester Metropolitan University, where he taught both academic and studio-based students. He is a practising artist, a painter, sculptor, printmaker and ceramicist.

The artist in front of his easel

He has exhibited at the Royal Academy; his work is represented in the Manchester Art Gallery and in many private collections in the UK and abroad.

He and his wife the painter Ghislaine Howard live in Glossop Derbyshire close to Lowry’s home. Michael has written the major text on LS. Lowry and has curated a number of exhibitions including Lowry’s industrial Landscape of 1953 at the Lowry December 2007-May 2008.

Michael has published widely on European art ot the nineteenth and twentieth centuries, mostly on the impressionists. His other books include L S. Lowry: A Visionary Artist, (He also worked on the film on the artist that acts as an introduction to the artist’s life and work at the Lowry Centre), He was commissioned to write a personal guide to the Manchester Art Gallery.

Michael represented the UK at the 2006 Varna Biennale and has featured on television and radio many times and in 2004 he and Ghislaine worked on the film Degas and the Dance which has received many awards including one of the prestigious Peabody awards.

What’s on- Coral Coraxalia Open Doors Rehearsal and Concert

Thursday 15 December 6.30 p.m. 

Local choir CoraXalia is having an “open doors” for everyone rehearsal on Thursday December 15^th 6.30 p.m. at the Cultural Centre (Manoas House) in La Viñuela.  This will be an inter-active experience between the public and the choir, to learn how choral music is put together and then we will put on a performance.  The  Town Council has kindly offered, hot chocolate (or coffee) with cake and mantecados afterwards.  Everyone welcome!

My beautiful Luca is looking for a new , loving home.

After two happy years, he has developed a strong dislike for one of my elderly pooches.  I don’t know why.  He is fine with all the others. He is a lovely dog and will make an endearing and loyal companion . He lives in the campo with my other five dogs, so is used to long walks.

He is about four years old (abandoned! ) , neutered and chipped.

Lost – or probably Stolen! purse

I withdrew some money from the Sabadell bank cash machine at about 1:05 midday and then went shopping with my husband in Aldi.  He paid with his cards, but when we returned home I discovered that my purse had gone missing – together with the cash and bank cards.   Pretty sure that this is a lost cause, but -although I  went back to Aldi within 10 minutes – suddenly nobody spoke a word of English – fortunately a lady was able to convey to the staff what I was searching for.   So word of warning – again!  My purse was in my handbag which has a secure fastening so obviously somebody skilled managed to extract it.  The handbag still has my keys (thank goodness) but I am pretty much up the creek without my cards.  On the seriously faint hope that someone could have some info. our telephone no. here is  603 652 102.  And everybody look out – nothing is safe it appears.  Thanks.  DianneLast

Spanish tax residency

In reply to Peter Wells.  Spain has not abolished the 183 day rule for considering you tax resident.  If you live here more than six months of the year they will consider you tax resident unless you can prove otherwise.   The issue has been that while Spain declared you tax resident here the UK might also consider you tax resident there if you spend more than 90 days in the year in the UK.

The agreement he published is designed to help decide which country you pay tax in  if you are in the position of being regarded as tax resident in both places.

In particular ‘centre of vital interest’ is not just where your pension is paid, it is where you make your life.

It is highly unlikely that you can have your home here, your spouse here and live here all year round and remain a UK tax payer.  Why would you?  One of the criticisms unfairly leveled at UK pensioners in Spain is that we ‘do not contribute’.  If we pay our taxes here we are fully contributing members of the community.

Taxed in the UK or Spain?

I note that some people are still alluding to the 183 day rule to determine in which country you are deemed to be resident for tax purposes. However, since the implementation, (in 2014), of the Double Taxation Convention between the UK and Spain, the 183 day rule no longer applies. (It was virtually impossible to enforce  anyway!). You can find the full convention document though the following link – https://www.gov.uk/government/uploads/system/uploads/attachment_data/file/507409/spain-dtc_-_in_force.pdf

In particular see paragraph 2, which defines the new rules for determining your resident status for tax liability. One of the main criteria is now, your “centre of vital interest”. i.e. the main source of your income. For example – Assuming you have a permanent property available to you in both the UK and Spain, and your source of income is UK pensions, you can be domicile in Spain for the full 365 days of the year, but still only be subject to UK taxes. (you will still, of course, be liable to IBI and the Non Resident tax in Spain).  As this convention is between the UK and Spain, it should be unaffected by Brexit. Also, you may find the banks asking for proof of your source of income, i.e. a UK tax return.
