SUPREME SANITY- Trump Exonerated By US Supreme Court; Sanchez’s Amnesty Law Rejected By Spain’s Supreme Court + He Gets Fined For Election Cheating…For The 4th Time!: Stories below.

***********

SPAIN

Spain’s Supreme Court rejects the amnesty, puts Sanchez investiture at risk, arrest warrants for the Puigdemont crew remain active: {Translation, summary}
– The embezzlement of the ‘procés’ cannot be erased. This is what the Second Chamber of the Supreme Court has assured this Monday in an order in which it refuses to apply the Amnesty Law to those convicted of the 1-O who remain disqualified, including Oriol Junqueras.
– The magistrates thus overrule the deputy prosecutor of the Supreme Court, María Ángeles Sánchez Conde, and, in line with the prosecutors whom García Ortiz removed from the case of the ‘process’ for refusing to apply the law, argue that in the actions of the pro-independence leaders there was a personal enrichment that the Amnesty Law itself excludes.
– The criterion of the Criminal Chamber translates into a domino effect for Puigdemont and the rest of the fugitives that Judge Llarena is keeping under trial, who in another order also notified on Monday maintains the national arrest warrants that weigh on them: if they set foot on Spanish soil they will be arrested.
– The Supreme Court’s decision has consequences for Sánchez’s government, whose investiture the pro-independence supporters made conditional on the approval of this law, whose unconstitutionality has been denounced from day one by the conservative parties.
– The magistrates draw attention to the striking contrast between the reinforced protection that the European Union attributes to the crime of embezzlement of public funds and “the leniency of the liberal Spanish legislators” who have not hesitated to pardon serious crimes, as well as the economic consequences that have resulted from them.
– What comes next? Appeals, of course. Former Catalan president Carles Puigdemont or other leaders of the procès-martial must first appeal to the court itself to reconsider, if that fails they appeal to the Constitutional Court, if that fails the last resort appeal is to the European Court of Justice.

Electoral Board fines Pedro Sánchez 1,500 euros for partisan statements in Doha, his 4th such violation since becoming President: {Translation, summary}
– The Government has received two sanctions from the JEC (Central Electoral Commission) in a single day, against its president and its spokesperson, following the meeting of this body this Monday in Congress. In its letter, the JEC dismantles the allegations presented by Sánchez against his sanctioning file, in which he asked for it to be closed without the imposition of any sanction, and fines him for breaching institutional neutrality in an electoral period. This is the fourth reprimand he has received for this since he has been president of the Spanish government.
– The Central Electoral Board (JEC) has imposed a fine of 1,500 euros on the President of the Government, Pedro Sánchez, for making partisan statements during his trip to Doha in the middle of the election period. During his official visit to the Qatari capital, the head of the Executive pointed to the PSC candidate for president of the Generalitat of Catalonia, Salvador Illa, as the best possible candidate. The governing body of the elections understands that he violated the due neutrality of the institutions and censures him for the fourth time.
– In addition to the president, Pilar Alegría, the minister spokesperson, was fined 2,200 euros for her attacks on the opposition in the press conference following the Council of Ministers on 7 May. Facua denounces that telephone spam continues unchecked: {Translation, summary}
– 98.3% of consumers continue to receive unsolicited commercial calls one year after their ban, according to a national survey carried out by Facua-Consumidores en Acción. Given this data, the organization has launched a platform for those affected by telephone spam to help them report these irregularities.
– Furthermore, 69.6% of those affected who, during a call, have expressly asked the teleoperator not to bother them again have subsequently received a new call offering them the services of the same company. However, 83.9% of people who failed to demand an end to calls and simply declined the offers indicate that they were again called with offers of the services of the same company.
– Only 9.9% of consumers say they know how to report unsolicited commercial calls. And only 2.1% of those affected say they have filed a complaint about it. Facua reminds consumers that the body to which they should refer is the Spanish Data Protection Agency (AEPD).
– The organisation advises users that, if they receive unauthorised commercial calls, they can file a complaint with the AEPD, which is the body responsible for monitoring compliance with these regulations. The association also handles complaints on behalf of members affected by telephone spam. The website https://facua.org/plataformas/antispam/ provides information on the steps to follow to file these complaints. TORROX

Torrox ‘Vive el verano’ (Live the summer) with concerts, open-air shows and summer cinema: {Translation}
– Torrox Town Hall is getting ready to enjoy a summer full of cultural activities, festivals and outdoor shows. The mayor of the town, Óscar Medina, the councillor for Culture and Popular Traditions, Salvador Escudero, and the councillor for Fiestas, José Luis Ruiz, presented this Monday the ‘Vive el verano’ programme, which includes “the best cultural agenda in the history of Torrox” and will reach all areas, neighbourhoods and audiences, according to the words of the councillor.
– There are few municipalities like Torrox with such a wide range of festivals and traditions,” said Medina, who revealed some new features for this summer such as the party that will take place on 27 July to celebrate the 40th anniversary of the neighbourhood of Generación del 27 or that the food trucks that were held in El Morche will be moved to the area of El Peñoncillo, with the idea that this event will be held in other neighbourhoods in future editions. The traditional foodtruck in Avenida de El Faro will be maintained from 11 to 14 July as “a sign of identity of our municipality”.
– Medina regretted that “it will be the first year without the cement slab where we held the fair in El Morche”, which also covered other activities. The mayor confirmed that “the fair is going to be held, the elderly will dance in the official stand as they do every year” and said that he would ask for a legal report to “demonstrate that the government has taken away the concrete slab that has been in El Morche for 60 years”.
– The Councillor for Culture and Popular Traditions, Salvador Escudero, has listed some of the consolidated activities in the months of July and August. There will be three concerts by the Asociación Cultural Vive la Música on 16 and 20 July, and on 4 August.
– Escudero explained that, as a novelty, the neighbourhood of Generación del 27 will experience “a magical night” on 27 July for its 40th anniversary. This celebration is being organised at the request of the residents themselves.
– The International Festival of the Choirs and Dances of Torrox will be on the 3rd of August, while the Fandangos de Güi will be held on the 24th of August. There will also be open-air summer cinema on the beach and in places in the old town such as Plaza Picasso and El Pontil.
– Other events of interest will be the Encuentro de Zambombas Villa de Torrox on 24 July in the Plaza de la Constitución, the final of the 34th edition of the National Flamenco Singing Contest ‘Con Duende’ on 27 July and the festivity of the Virgen de las Nieves, with the procession of the patron saints on 5 August. The summer programme will end in September with the Fiesta de las Candelarias on the 7th and the Day of the Tourist, which this year will be held on the 14th of September.
– The celebration of the Loona Summer Festival is on Saturday 3 August at the football field of El Morche, with Omar Montes as the big headliner. And La Granja will close the month of August with the Closing Summer Festival on Friday 30th and the 90 Lovers Festival on Saturday 31st.
– The eagerly awaited Feria de El Morche will be held from 14 to 18 August, the last night being the traditional grand maritime-terrestrial procession of the Virgen del Carmen.

– The Nerja Councillor for Commerce, Antonio López, informs that next Sunday, 7th July, there will be no flea market for antiques and second hand goods in the market area located in the surroundings of the Urbanización Almijara. On that day the space will be used as a parking area.
– López points out that the ADISMA association, responsible for the operation of the Sunday flea market in the municipality, has been aware of this circumstance for several weeks, and has been responsible for informing vendors and regulars of the closure of the flea market for next Sunday.
– The flea market of antiques and second hand goods in Nerja will resume its activity as usual on Sunday 14th July, continuing as usual Sunday after Sunday. Source & photo, Spanish:

VÉLEZ-MÁLAGA

Councillors in Vélez-Málaga unanimously approved a motion to suspend controversial mobile phone mast project:
– Vélez-Málaga town hall on the eastern stretch of the Costa del Sol approved the immediate suspension of work to install a new mobile phone mast in the coastal village of Almayate during its last council meeting on Friday 28 June.
The move comes after protests by local residents that started in May.
– Councillors voted in favour of suspending the plans until the corresponding bureaucratic procedures are completed as “some documents are missing”. The motion calls on the ministry for industry to review the licence granted for the mast.
– Residents have voiced concerns that the pole would be located less than 200 metres from their homes, a primary school, a nursery and a library. However, at the time the owner of the plot of land where the mast is to be installed replied that Vodafone, the mobile phone company installing the mast “has all the permits”.
– During Friday’s meeting there was a verbal confrontation between the spokesman for Andalucía por Sí, José Pino, and the mayor of Velez, Jesús Lupiáñez (PP). The Andalusian leader accused the mayor of “thinking that the people of Almayate are stupid”, which provoked an angry reaction from Lupiáñez, who accused him of “lying and inventing these statements”, asking him to “keep his decorum and not confront the residents”. EUROPE

Meta accused of breaking EU digital law by charging for ad-free (and supposedly snoop-free) Fakebook & Instagram:
{I told readers when this new policy was implemented that is was wrong, and for that reason I quit using Fakebook. Evidently Brussels agrees. Meta does whatever it wants and sees fines and sanctions as a business expense. It is time to break up the abusive, shameless, unrepentant, tech mega-giant Meta. -Ed.}
– The European Commission has accused Mark Zuckerberg’s Meta of breaching the EU’s new digital laws with an advertising model that charges users for ad-free versions of Facebook and Instagram.
– Meta launched a “pay or consent” model last year in an effort to comply with the bloc’s data privacy rules, under which users pay a monthly fee for an ad-free version of Facebook or Instagram that does not use their personal data for advertising purposes. If users do not pay, their data is used to tailor personalised adverts that appear in their social media feeds {…by sharing the data with thousands of Meta business partners}.
– The European Commission, the EU’s executive body, said the model did not comply with the Digital Markets Act (DMA), which is designed to rein in big tech companies. The commission issued preliminary findings from an investigation into “pay or consent” on Monday and found the model “forces users to consent” to their data being collected from multiple platforms if they don’t want to pay. Meta also does not allow users to choose a service that uses less of their data but is broadly similar to the “with adverts” versions of Facebook and Instagram, the commission said.
– Anne Witt, a professor of antitrust law at EDHEC Business School in France, said the key question behind the case is whether consumers “freely consent” to their data being collected when the choice is either to pay for a service or use it free of charge, but with the caveat that Meta is then allowed to build profiles of them for advertisers.
– The commission must finish its investigation by the end of March next year and Meta faces a fine of up to 10% of global turnover – equivalent to $13.5bn (£10.5bn) – if it is deemed to have breached the act. The commission said last week that Apple had breached the DMA by restricting competition on its app store. UK music festivals ‘need intervention’ – as number of cancellations hits 50:
– Geronimo and Towersey are among the latest festivals to announce cancellations due to rising costs – with the Association of Independent Festivals warning the number going under could reach triple figures by the end of 2024.
– The 50 so far this year means the total lost since the start of the COVID pandemic in 2019 now stands at 182, says the AIF, with many more predicted to cancel by the end of 2024 due to the “pressures of unpredictable and rising costs”. USA

Supreme Court affirms absolute immunity for official acts in Trump case, renders Jan. 6 trial before election unlikely:
– The US Supreme Court ruled Monday that former President Donald Trump enjoys absolute immunity from prosecution for “official acts” during his presidency, without saying whether his alleged 2020 election subversion falls under that. The nation’s top court instead left it up to the lower courts to sort out what constitutes an “official act” by a sitting president, and whether that applies in the 2020 election subversion case.
– In a 6 to 3 decision authored by Chief Justice John Roberts, the panel stressed that the “president is not above the law,” and that “not everything the President does is official.” All three liberal justices dissented.
– The high court’s ruling vacated an earlier decision by a lower court judge rejecting the immunity theory and cleared the way for more appeals by the former president that could set the “Jan. 6th DC demonstration” trial schedule back months or years, if it ever happens.
– “Like everyone else, the President is subject to prosecution in his unofficial capacity. But unlike anyone else, the President is a branch of government, and the Constitution vests in him sweeping powers and duties,” Roberts wrote in a lengthy 43-page decision. Another mis-diagnosis award against Andalusian Health Service (SAS): {Translation, summary]
– The Consultative Council of Andalusia (CCA) has endorsed the partially estimatory resolution issued by the Andalusian Health Service (SAS) to compensate with 63,428.78 euros to a patient who lost an eye after going to the emergency services of the High Resolution Hospital of El Toyo, in Almería.
– The resolution considers that the proposal made by the SAS is “in accordance with the law” compared to the 97,035 euros demanded by the person affected by the “diagnosis error” based on the scale for the assessment of damages and losses caused to people in traffic accidents.
– The claimant began his actions when he considered that there were care failures in the two treatments provided to him in the emergency department of the aforementioned hospital on August 2, 2017, which caused him to lose his left eye. Specifically, he refers to an “error in the diagnosis” of a corneal ulcer when in reality “he was suffering from a penetrating eye injury”, which was not diagnosed until the following day when he went to the Hospital Universitario Torrecárdenas with a severe infection that forced him to have the eye removed. Helping Parents Protect Kid’s Online Activities & Slow The Huge Spike In Sex-related Violence Among Youth – Viewing Porn In Spain Will Soon Require Registering Your ID With The Gov’t & Installing Their App “Cartera Digital”: {Translation, summary}
– The government on Monday presented the technical characteristics of the tool it hopes to use to prevent minors from accessing pornography on the Internet. The solution will take the form of a mobile phone application that will verify the age of each user when they request access to an adult content platform. It will be called “Cartera Digital” (Digital Wallet).
– The Minister for Digital Transformation, José Luis Escrivá, explained that the first version of the app will be available “after the summer”. From then on, the government will begin to require porn websites to incorporate this solution to verify the age of those who visit them, which in practice will make the app compulsory for all users who wish to access this type of content from Spain.
– The tool will work in two steps. In the first step, the user will have to register in Cartera Digital with the electronic ID card, the Cl@ve system, a digital certificate or other valid identity verification solutions for government procedures. In the second, when the user tries to access an adult content platform, the website (or the browser, if it is not based in Spain) will require the user to confirm that he/she is of legal age, which can be done by scanning a QR code that will appear on the screen.
– The government hopes that this pressure from the EU will push the different actors involved in the app’s success to implement it. However, Ministry sources acknowledge that the mere launch of the tool “is not enough” to solve the problem of access to porn by minors. Also that “there are ways to circumvent” its effectiveness, such as the use of services to hide the geographical location of users, like VPNs.
– Escrivá framed this initiative within the “more than necessary national agreement to safeguard the health of minors”. In this regard, the minister shared data on the impact of pornography on minors and related it to the increase in sexual assaults in this age group, which has risen by 116% in the last five years.
– According to figures provided by the Executive, the first access to pornography in Spain is now between the ages of 9 and 11. From adolescence onwards, 70% of minors consume pornography “on a regular basis”, mainly via mobile phones.
– This consumption has an impact on the way they conceive intimate relationships, generating “emotional and sexual problems”, a “distorted perception of sexuality” and a “serious risk of addiction”, Escrivá said. At the moment, 90% of young adults (aged 18 to 26) consider porn to be “faithful to reality”, 50% of them “act by imitation and sometimes by domination” and almost a third recognise that the adult content they see on the internet is “their only form of affective-sexual information”.
