For hardcore Spanish politics news followers I have included a few articles to keep you up to speed. What I do cover in depth today is the state of the Globalist Agenda, in their own words. The Supreme Court takes the amnesty law to the Constitutional Court with “the absolute conviction” that it violates the equality and legal security functions of the constitution- “The Amnesty Law is repugnant to the Constitutional Law”: {Translation}
– The high court calls the pro-independence leaders on trial for the ‘procés’ a “coup” and points out that “the democratic system itself is in question” with the measure of pardon.
– In the harshest terms, basically unheard of in the vocabulary of the Supreme Court, the Criminal Chamber of the high court agreed on Wednesday to promote a question of unconstitutionality against the first article of the amnesty law. The high court, highly critical of the controversial law, which it has gone so far as to describe as “repugnant”, on this first occasion that it has brought the text before the court of guarantees, considers that it violates the constitutional right to equality before the law, as well as the principles of legal certainty and the prohibition of arbitrariness proclaimed in the Spanish Constitution. And that, subsidiarily, it could even violate the principle of jurisdictional exclusivity.
– The decision to take to the Constitutional Court the regulation promoted by Pedro Sánchez and which allowed his investiture with the support of the pro-independence supporters has been taken by the Supreme Court at the first opportunity it has been presented with- during the examination of a ‘minor’ appeal: that of a person convicted of aggravated public disorder for some events that occurred in Girona in October 2019, after the publication of the Supreme Court ruling on the case of the procés, consisting of the throwing of stones or pieces of stone against the city’s courts.
– On 10 July, the Chamber gave the parties a period of ten days to present their arguments on the presentation of the question, and the magistrates did not let this first occasion pass them by. In their order, they do not mince their words: “the rule in question is repugnant to the constitutional right to equality before the law”. What is more, they state that the reasons ” cited to justify the clearly discriminatory treatment that the rule imposes” are “entirely arbitrary”.
– “The constitutional system is replaced by what has been graphically called a sort of permanent revisable amnesty, also contravening the principle of legal certainty and altering the foundations of democratic coexistence, with the added effect of introducing a sort of criminogenic factor”, the text of the question goes on to state.
– The judges stress the transcendental importance of this first question of unconstitutionality. “We are not dealing here with a political debate of greater or lesser importance. It is the constitutional principles and the democratic system itself – not as easy to achieve and preserve as lazy habit would have us believe – that are at issue here,” says the 49-page order, which is full of disqualifications of the law and the decision to implement this rule, which, they insist, has “transgressed” constitutional limits.
– In fact, the Chamber headed by Manuel Marchena affirms that although technically they are addressing the court of guarantees to consult on the constitutionality of the rule, in reality they have no doubts that it is not in accordance with the Magna Carta. “We are not presenting a doubt, in the true sense of the term, and we are interested in clearing it up. We have the absolute conviction that the rule in question violates constitutional precepts”, states the resolution, which recalls that some of the crimes committed during the procés and the subsequent unrest of autumn 2019 – and which the law now seeks to amnesty – were committed “precisely by those who, in their capacity as authorities or public officials, were most obliged to comply with the Constitution and the laws”. Brussels criticises the government’s pressure on judges, and the lack of independence of the attorney general’s office that has become a partisan tool for the furthering of a political agenda by the President: {Translation, summary}
– The European Commission still has many warnings to make to Spain regarding the rule of law, although it is tiptoeing around the amnesty law for the time being while they continue their investigation, as can be deduced from the annual report on the situation in the country. The new laws of the Sánchez government are still being studied by Brussels, but the EU executive censures some statements by members of Spain’s executive office and warns of illegal pressures on judges. It also reminds that the country must continue to work on ensuring that the figure of the Attorney General has sufficient independence “in accordance with European standards”. Sánchez attempts to overrule the judge, says his statement must be in writing and not in Moncloa because it is “inseparable” from his status as president: {Translation, summary}
– Sánchez has sent a letter to the judge who is investigating his wife and who has summoned him as a witness in the case. In the text, he explains that he is willing to “collaborate with the Administration of Justice”, but not in the manner proposed by the investigator Juan Carlos Peinado. The judge has ordered to take his statement in La Moncloa, considering that the matter is outside his function, but Pedro Sánchez defends that he must respond “in writing” because his appearance “is inseparable from the condition of President of the Government”.
– However, Sánchez’s position is the opposite of the one expressed by the investigating judge in the order he issued to summon him as a witness. In that document, the judge cited Sánchez as the “husband of the investigated woman”. And he alluded to the third paragraph of article 412 of the Criminal Procedure Act (LeCrim). This article establishes in its second point that several institutional officials, including the president of the government, can testify in writing when they are summoned as witnesses on a matter that they have known by reason of their position.
– But the third paragraph, the one cited by the investigator, explains that “if it is convenient to receive a statement from some of the persons referred to in paragraph 2 of article 412 [including the president] on matters of which he has not had knowledge by reason of his office, the statement shall be taken at his home or official office”.
– In short, Judge Peinado believes that Sánchez’s relationship with the case involving his wife is unrelated to his role as Prime Minister. All this despite the fact that in a previous order he explained to Begoña Gómez that he is investigating her for the events that have occurred “since her husband has been president of the Government”. 
– Pedro Sánchez, on the other hand, considers it “notorious” that his appearance “is inseparable from his status as President of the Government”. As a result, he does not believe that the third paragraph of the article – which would oblige him to make a statement in Moncloa – is applicable, but rather the second. “Given the issues that are the subject of the aforementioned proceedings, this statement must be made in accordance with the provisions of article 412.2 of the law on criminal prosecution, which states that, due to my role as president of the government, my statement must be made in writing”.
– Whatever the form of the statement, Pedro Sánchez will not be obliged to answer the questions put to him by the examining magistrate. By virtue of article 416 of the LeCrim, his status as the husband of the person being investigated in the case exempts him from this duty and allows him to avail himself of his right not to testify.
