Europe concludes that severance pay in Spain is not “high enough”: {Translation, summary}
– The European Committee of Social Rights agrees with UGT and rules that Spain is in breach of the European Social Charter and its dismissal law contravenes EU law by not complying with the obligation to provide adequate compensation when the dismissal is unjustified. “There is a violation of article 24.b of the European Charter”, concludes the Strasbourg-based committee by thirteen votes to one in a resolution published on Monday to which this newspaper has had access.
– It does so in response to a lawsuit filed by UGT in March 2022 in which it denounced that unfair dismissal in Spain does not compensate the damage suffered by the affected nor does it have a dissuasive effect on employers. The union denounces that the worker “only” has the right to automatic compensation by law, which establishes a maximum limit – set at 33 days per year worked and with a maximum of 24 monthly payments (provided that the employer does not choose to reinstate the worker) – and therefore “does not take into account the real damage suffered”.
– This is also the view of Strasbourg. Specifically, the Committee considers that “the ceilings set by Spanish legislation are not high enough to compensate for the damage suffered by the victim in all cases and to dissuade the employer”. It also argues that “the actual harm suffered by the worker concerned may not be adequately taken into account in relation to the specific characteristics of the case, not least because the possibility of additional compensation is very limited”. Consequently, the Committee considers that the right to adequate compensation or other appropriate redress within the meaning of the European Social Charter – to which the Spanish Government has subscribed – “is not sufficiently guaranteed”.
– The Committee considers that the predetermined compensation may serve more as an incentive for the employer to dismiss workers unfairly. In fact, it warns that, in certain cases, compensation ceilings could lead employers to make a pragmatic estimate of the financial burden of unfair dismissal on the basis of a cost-benefit analysis, which, in some situations, could encourage unfair dismissals. Fiscal Irresponsibility As €11B+ In Recovery Aid Is Withheld- Spain has left one out of every five euros of European recovery funds unallocated: {Translation, summary}

Meet The New Andalusian Government: {Translation}
– At around three o’clock this Monday afternoon, the president of the Junta de Andalucía, Juanma Moreno, announced the new organisational structure of his new government. Halfway through the legislature, Moreno wanted to breathe new life into “the Andalusian way”. In total, the Governing Council will be made up of eight women and six men, in addition to the president of the Junta himself.

In this way, Arturo Bernal will be left only with Tourism and Andalucía Global, while Ramón Fernández-Pacheco will focus on Agriculture, Fisheries, Water and Rural Development.

Scandinavian, German, Dutch & Russian tourist numbers drop as Malaga prices soar- The United Kingdom and the United States are the main countries of origin for tourists who spend the night in Malaga: {Translation, summary}
– Despite what the mainstream media would have you believe, growth in tourism in Spain is rather flat and is projected to remain that way through the decade. See chart below.
– The Hotel Occupancy Survey published last week, published monthly by the National Statistics Institute for the month of June, shows that the city of Malaga has registered a total of 292,449 overnight stays by 143,109 hotel travellers, resulting in an average stay of 2.04 days. This represents an increase of 2.21% in overnight stays and 3.57% in hotel travellers compared to the same month last year, as indicated by Malaga City Council in a statement.
– The United States is the second largest international market in terms of the number of hotel travellers in Malaga during the month of June, with 8,073 travellers and 17,667 overnight stays, only behind the United Kingdom, where 12,859 travellers have come from, who have spent 31,331 nights in hotels. The United States is followed in terms of the number of hotel travellers by those from Italy (8,033), Germany (6,020), France (5,649) and the Netherlands (4,962). In terms of average stays in these countries of origin, the case of the Netherlands stands out, sixth in terms of the number of hotel travellers but fourth in terms of overnight stays (15,395), with an average stay of 3.10 days. A dangerous gang dedicated to the robbery of homes and cars for the transport of drugs is captured in Málaga: {Translation}
– The Guardia Civil has arrested five people in Malaga after dismantling a dangerous gang dedicated to the robbery of homes and high-end vehicles which they then used to transport drugs and carry out drug robberies – the theft of drugs from other criminal organisations. The organisation was based in Alhaurín el Grande and Mijas and was “especially dangerous” as they used a lot of violence and weapons in their crimes.
– The investigation, known as operation ‘Julia’, began in mid-March, when the agents located two stolen cars with false plates and evidence of having been used to transport drugs. – This August Fair will feature on Friday the 2nd with the XXXVI edition of the Flamenco Singing Festival. At 00:00 in the Plaza de la Constitución the XXXVI Flamenco Cante Festival will begin. This year it will feature Julián Estrada singing accompanied by Jesús Zarrías; Laura Vital with Paco Vidal; Morenito de Íllora (son) with Nono Reyes, who will also play the singer Antonio Reyes. It will be presented by Antonio Gavilán. The dance show will be performed by local artist Matías Campos and Fátima Navarro. Abraham Campos will be singing, Juan Requeda and Javier Flores ‘El Indio’ will be on guitar, and Robert Peralta will be playing percussion. Pepe Calayo and José Román on guitar will also perform.
– On Saturday, August 3, the flowered reveille will mark the beginning of the festivities. At 4:00 p.m., the Town Hall will invite paella and an hour later there will be a foam party with a 50-meter water slide. At 6:30 p.m. there will be a piñata and ribbon race. At 8:00 p.m. there will be the mass and procession in honor of San Sebastián. – Sunday, August 4, there will be a meat tasting, and again a foam party. At 8:00 p.m. there will be the mass and procession in honor of San Sebastián. At 1:00 a.m. Flowthiago will perform. Both nights will be closed by the Decibelios Orchestra. The geek’s charity flea market returns to Vélez-Málaga for the second year running: {Translation}
{“Geek Culture” is a celebration of all things nerdy, imaginative, and unconventional. At it’s core, geek culture embodies a deep enthusiasm for intellectual pursuits, often rooted in science, technology, fantasy, gaming, comics, anime, and more. -Ed}
– This summer, the San Francisco market will become an enclave where geek culture and solidarity will merge with the second edition of a flea market with this theme. On Saturday 3rd August, the Concejalía de Juventud de Vélez-Málaga, together with the NGO Infancia Solidaria and Eventos Go! will organise an event that will immerse attendees in a geek atmosphere.
– The first edition of the flea market, held last summer, attracted more than 1,000 visitors and established itself as a reference in the local cultural agenda. This year, the councillor for Youth, Lourdes Piña, and Julián Rodero from Eventos Go! presented the event, highlighting its previous success and the new additions for this year’s edition.
– The Councillor for Youth pointed out the remarkable popularity of the geek world in the municipality and the region, underlining that more than 1,000 people attended the event in the previous edition. “The reception was so positive that we decided to repeat the market, hoping to achieve the same success and enthusiasm as last time,” she said.
– The market will open its doors from 17:00 and will run until midnight, transforming the San Francisco market into a hub of activities. Attendees will be able to explore a themed market offering unique products related to geek culture, take part in competitions and interactive challenges, and enjoy activities such as softcombat games and soft archery. Admission is free, providing access to a wide audience and encouraging greater participation.
– In addition to the entertainment on offer, the flea market has a strong charitable component. All proceeds raised during the event will go to Infancia Solidaria, an organisation that works to provide medical treatment for children with serious health problems. The NGO is responsible for bringing children with incurable diseases to Spain to provide them with the care they need and improve their life prospects. The fundraiser will also include additional donations through a “fila cero” (zero line) available during the event.

Travelers who canceled trips due to COVID have the right to a refund even if the company is insolvent: {Translation}
– The Court of Justice of the European Union (CJEU) has confirmed on Monday that travellers who cancelled their package holidays due to the coronavirus pandemic in 2020 have to be reimbursed for payments made even if the organising companies subsequently became insolvent.
– The case concerns a group of Austrian and Belgian customers who, following the bankruptcy of their travel organisers, asked the insurance companies to reimburse them for the payments made. The insurance companies refused, claiming that they only guaranteed the risk that the trip would not be carried out due to the organiser’s insolvency and stressing that the trips did not take place because it was the clients themselves who cancelled the activity following the crisis triggered by the coronavirus pandemic.
– Despite the fact that the organiser’s insolvency only occurred subsequently, the CJEU has stressed that the guarantee laid down in the European directive also applies “where a traveller cancels the holiday due to unavoidable and extraordinary circumstances and, following that termination, the organiser becomes insolvent”. In this regard, the European Court points out that “there is no reason to treat differently travellers whose package holiday cannot be performed because of the organiser’s insolvency and travellers who have cancelled their holiday”.
– The CJEU therefore interprets the right to reimbursement as being deprived if, where the insolvency of the organiser occurs after the cancellation, the guarantee against such insolvency does not cover the corresponding rights to reimbursement.
*Consumer jurisdiction lawsuit*
– In another ruling concerning the travel sector, the CJEU confirmed on Monday that the customer of a travel organiser can sue the travel company in its own jurisdiction if the destination of the trip is abroad. In this way it follows the ‘Bruselas I bis’ regulation, which establishes as a general rule the jurisdiction of the courts of the Member State of the defendant’s domicile. Thus, the CJEU explains that the regulation does not merely determine international jurisdiction but territorial jurisdiction, since it confers jurisdiction directly on the court of the place where the consumer is domiciled. The aim is to ensure that the consumer, as the weaker party, can sue the stronger party before a court that is easily accessible.
