The Supreme Court confirms that the embezzlement by the leaders of the ‘process’ is not covered by the amnesty- “Laws cannot be interpreted as a verbal mandate addressed by the political power to judges”: {Translation, summary}
– The court that tried the leaders of the ‘procés’ in the Supreme Court has rejected the appeals filed by the Prosecutor’s Office, the State Attorney’s Office and several defendants and has confirmed that the amnesty is not applicable to the crime of embezzlement. The Court of Appeals has ruled that the crime of embezzlement committed by the disqualified Oriol Junqueras, Raul Romeva, Jordi Turull and Dolors Bassa is expressly excluded from the law.
– The Supreme Court confirms this decision of the lower court. Asking the Chamber to interpret the law according to the will of the legislator “is asking us to abdicate our function as judges”. “Laws cannot be interpreted as a verbal mandate addressed by the political power to judges. Legal texts, as written texts, contain a mandate that is embedded in their own letter.”

The price residents pay to provide tourists with water all summer- Filling swimming pools and watering gardens banned in Malaga and on the Costa del Sol as new drought restrictions awaited:
– Restrictions on refilling swimming pools and watering gardens will be reinstated as reservoir levels in Malaga province dwindle below 100 cubic hectometres as the drought crisis continues to bite.
– It comes as this Monday 30 September marks the end of the hydrological year, which has been worse than the previous one due to the continued lack of rainfall. This Monday also marks the ending of permissions to refill swimming pools and water gardens without limits. These will be prohibited until the drought committees meet this week to assess the situation in all Andalusian basins. Regional sources say it is highly likely restrictions will have to be tightened. TORROX
They confirm the conviction of a Torrox police officer for the “unjustified attack” on a detainee: {Translation, summary}
– The Superior Court of Justice of Andalusia (TSJA) has confirmed the conviction of a local police officer of Torrox for abusing his position and assaulting in an unjustified manner a detainee, who also broke the victim’s cell phone in police premises. The magistrates have ratified the sentence of nine months imprisonment for the agent for the crime against moral integrity, for which he has also been disqualified for two years for the exercise or position in the Security Forces and Corps, as stated in the sentence, to which SUR has had access.
– The facts date back to March 29, 2020, in full Covid confinement. Although the aggression referred to in the judicial resolution occurred inside the headquarters of Torrox, it all started a few hours earlier. Specifically, around 4.50 p.m., when the accused officer was on patrol and saw that the victim’s motorhome was carrying German license plates that had expired the day before.
– The victim’s friend explained to the officers that, due to the suspension of deadlines as a consequence of the declaration of the state of alarm by the Covid-19, they had not been able to register the vehicle in Spain, but that all the documentation was in the possession of the manager to do so as soon as it could be done. However, according to the judicial document, the officer, after insisting that the plates were expired, went to the motorhome and ripped off the front license plate, which was immediately objected to by the woman.
– Faced with the witness’s “logical state of alteration”, the sentence states, the agents put her in the police car. Meanwhile, at a time when the owner of the caravan was showing the documentation to another officer, the defendant officer “approached from behind grabbing him by the neck” and, despite the man’s attempt to free himself, “threw him to the ground”, after which he remained motionless for several seconds, a situation that other officers took advantage of to put him in shackles.
– The scene, apparently, was recorded by numerous witnesses, to whom the police indicated that they should erase the images from their phones, according to the resolution. Then, while the victim – who was handcuffed – was being taken to the jail, the same officer hit her on the head “unexpectedly”, which caused her to fall to the ground. This conduct, according to the ruling, was reproached by another officer.
– The Provincial Court, which had already condemned these facts in the first instance, concluded that the police officer “not only used unjustified violence to proceed with the arrest” of the injured party, “but subsequently used violence again against the aforementioned when he was detained and handcuffed in police premises without any possibility of reaction, which is an obvious attack on his dignity and moral integrity”.
– As a result of these facts, the arrested person suffered erosions on his wrists and knees, on his right elbow and on his left frontal area, which took three days to heal after an initial medical assistance.
– The TSJA has just confirmed the sentence for the municipal official, who has been sentenced to nine months in prison and two years of special disqualification for the exercise of employment or position in the Security Forces and Corps, as well as two fines totaling 600 euros for a misdemeanor of damage and another misdemeanor of injury. On the other hand, he will have to compensate the man in the amount of 3,090 euros for moral damages and injuries, in addition to paying him 350 euros for damages to his cell phone. MIDDLE EAST
Israel’s Lebanon ground invasion begins with ‘limited’ raids on Hezbollah:
– Israel’s widely expected ground invasion of Lebanon appeared to be getting underway early on Tuesday as its military said troops had begun ‘limited’ raids against Hezbollah targets in the border area. The military said in a statement that its targets were located in villages close to the border that posed “an immediate threat to Israeli communities in northern Israel.” It said the air force and artillery were supporting ground forces with “precise strikes.”
– Local residents in the Lebanese border town of Aita al-Shaab reported heavy shelling and the sound of helicopters and drones overhead.
– Hezbollah’s deputy leader Naim Qassem, in a first public speech on Monday since Nasrallah’s death, said that “the resistance forces are ready for a ground engagement.” Full article: https://www.reuters.com/world/middle-east/israeli-military-has-begun-limited-raids-against-hezbollah-targets-border-area-2024-09-30/
TECH
The National Police warns about the danger of having this cell phone button on- you could be a victim of “bluesnarfing“: {Translation, summary}
– “Are you one of those who always have your cell phone’s bluetooth activated? Well, watch out, because you could be a victim of bluesnarfing,” explains a spokeswoman for the Corps in a video posted on its TikTok account.
– “It is enough that the cybercriminal is 10 or 15 meters away and you have the bluetooth activated so that he can access your phone”, explains the Police, who indicates that this is a technique frequently used to ‘steal data’.
– The bluesnarfing cases are characterized by the fact that it is not strictly necessary for users to accept permission for the offender to gain access to the mobile device. Therefore, it is very important to have the cell phone updated with the latest security patches.
– Criminals seek to steal data related to emails, messages or files stored on the device. “Then hackers tend to sell them on the dark web or use them to commit other types of scams or extortion,” the agent continues.
– “To prevent this from happening to you, update your device’s software, activate Bluetooth only when you are going to use it and reject any Bluetooth request coming from unknown devices,” the police recommend in conclusion. PETS
New Pet Law Clarification- “compensation for basic veterinary expenses” is allowable in adoptions: {DigameXtra}
– I’ve now read the entire final version of the BOE official document of the new animal laws, all 54 pages!
https://www.boe.es/boe/dias/2023/03/29/pdfs/BOE-A-2023-7936.pdf
Here’s what I found about payments or required donations for dog adoptions.
– Page 7: In any case, dogs, cats and ferrets, independently of the
of the purpose to which they are destined or of the place in which they live or from which they come, will be considered as “companion animals”.
– Article 58, page 37, “Transfer and adoption of companion animals”,
#4. The surrender for adoption of companion animals can only be carried out by public centers of animal protection or registered animal protection entities and must be accompanied by an adoption contract that will contain minimum clauses to be established by regulation.
– Here is the part about adoption costs:
#9. La adopción no será en ningún caso objeto de transacción comercial, sin perjuicio de que se pueda solicitar la compensación de los gastos veterinarios básicos.
[The adoption shall in no case be the object of a commercial transaction, without prejudice to the possibility of requesting compensation for basic veterinary expenses.]
– So, as I read it, legally registered dog adoption services asking for “compensation for basic veterinary expenses” is allowable.
– But a heads up regarding the rest of the new animal law! This is Spain. This very controversial, very comprehensive 54 page law will now be the subject of all types of objections, complaints, challenges, and inevitably, lengthy court cases. Already in the news are protests from the meat, egg and dairy production industries. I’ve read articles claiming new animal safety & transport regulations will quadruple the price of shipping live animals, and that eggs and poultry will skyrocket when new confinement rules require halving the population to meet new density limits. They warn this will turn Spain from a net meat exporter to a net meat importer.
