Ministry of Consumer Affairs investigates real estate companies for illegally charging renters commissions on housing rentals: {Translation}
– The Ministry of Consumer Affairs has opened an investigation to different housing rental management companies for allegedly charging tenants illegal commissions or forcing them to sign temporary contracts without such temporality being justified. The Directorate General of Consumer Affairs would have found, through various complaints filed by consumer associations, that these practices, prohibited by Law 12/2023 by the right to housing, would be carried out by companies operating throughout the Spanish territory.
– In this sense, the Consumer Affairs Ministry points out that transferring to tenants the costs of real estate management and the formalization of the contract is expressly prohibited by the “Law 12/2023 of May 24 for the right to housing”, as well as the signing of temporary contracts in which the temporary nature is not justified.
– Likewise, the Ministry headed by Pablo Bustinduy, points out that housing is a right and a basic necessity protected by the “Urban Leasing Law”, a regulation that
prevents real estate agencies from including clauses or practices that violate the rights of tenants. In fact, these clauses or practices could be considered serious infringements, with fines of up to 100,000 euros, or very serious with penalties of up to one million euros. These amounts could even exceed those fixed with between four or eight times the illicit benefit obtained, according to Consumer Affairs.
*Property management and contract formalization expenses*
– In May of this year, Facua already warned that real estate agencies were charging tenants a commission that landlords actually have to assume. These are the real estate management and contract formalization fees in the case of long term contracts, i.e., those aimed at satisfying the permanent need for housing.
– Until the entry into force, at the end of last May, of the new Law on the Right to Housing, which introduced a modification in article 20 of the Urban Leases Law of 1994, the payment of this commission corresponded to the landlord when it was a legal entity (companies), but when it was a natural person, the law proposed that landlord and tenant agree on how to share this expense. According to the new regulations, this payment now always falls on the landlord, regardless of their status (company or individual).
– One of the real estate companies that Facua denounced for this reason was Alquiler Seguro, which is now among those investigated by the Ministry of Consumer Affairs. According to the consumer organization, Alquiler Seguro is allegedly charging an amount equivalent to one month’s rent plus VAT for offering a “tenant assistance service”, which includes, among others, “advice on how to change the ownership of energy supplies”, “legal advice” on the rental contract and even “resolution of claims and incidents”. However, the organization points out that this type of management service has to be provided by the landlord, not by the intermediary rental agency for a fee. The Begoña Investigation Will Continue- The TSJ of Madrid dismisses Begoña Gómez’s complaint against Judge Peinado for being based on “mere conjecture”: {Translation}
– The Superior Court of Justice of Madrid (TSJM) has agreed to dismiss the complaint filed by Begoña Gómez against the judge who is investigating her, Juan Carlos Peinado, for an alleged continuous crime of prevarication and for alleged crimes of disclosure of procedural actions declared secret and/or information of which she has knowledge by reason of her office and which should not be disclosed.
– The magistrates, in line with the criteria of the Prosecutor’s Office, understand that there is no evidence of “the tortious departure from the norm alleged by the plaintiff”, as stated in the order collected by Europa Press.
– It is the third complaint filed against Peinado that the TSJM rejects in the last month: the first was that of the journalist Máximo Pradera; and the second, that of the President of the Government, Pedro Sánchez.
– In the complaint, Gómez’s defense claimed that the head of the 41st Court of Instruction of Madrid had transferred documents declared secret to investigators and this would have caused them to be published by different media. In her opinion, this action had seriously harmed her, since information and proceedings declared secret had been disclosed while she was unaware of all the details of the investigation, causing her defenselessness. “Despite the fact that the case was secret, it was transmitted live by the media”, said her lawyer, Antonio Camacho. Nerja City Council undertakes the clearing and cleaning of the Chíllar River: {Translation}
– The Councillor for the Environment of Nerja, Javier Rodriguez, has announced that this week the work of clearing and cleaning the riverbed of a section of the river Chíllar begins, from the mouth to the quarry, as part of the action program of conservation and maintenance of the channels of urban areas of the municipality.
– The works have an execution period of ten days and are being carried out by the company Excavaciones Beniex SL, with an investment of 20,242.09 euros which is financed with municipal resources. Rodriguez has detailed that “this action will be carried out on both banks of the river Chíllar, with an approximate length of 3.6 kilometers, removing plant debris and non-biodegradable items such as garbage and plastics.”

France makes the temporary tax on the rich a permanent levy:
– France’s minority right wing government suffered a major blow when left wing and centrist deputies united to make a temporary tax on the rich into a permanent levy.
– The government had proposed a special tax on the rich for three years to help reduce a crippling public deficit which it estimates could hit 6.1 percent of gross domestic product in 2024. Under European Union rules it should be a maximum of three percent.

Typically the purchase would be signed for a period of 15 years. – In addition to these options, to which it should be added that the owners of the villas can at any time rent or sell their cabins, the services included with the purchase of a cabin are very similar to those of a regular cruise ship. Offered daily menus that change every 14 days which include a breakfast buffet and a dessert buffet at dinner, basic drinks are also included in this package. With the possibility to make use of two party rooms, a library, a gym and different bathing and spa areas, this ship also offers an operations center where residents can access the Internet to perform their respective jobs. It also has a complete medical service, a cabin cleaning service twice a week and a laundry service, as well as a personal storage area outside the cabin. The excursions made by this ship in each of its ports of call are established in packages that include free and paid routes depending on the destinations.
– In addition to the philosophy of life and travel offered by this vessel, it should be mentioned that the 195-meter, eight-deck Odyssey can accommodate a maximum of 650 resident passengers. Built at the Spanish shipyard Unión Naval de Levante in 1993, this ship, which has sailed under six different names, was lengthened by 31.2 meters at the German shipyard Blohm+Voss between May and June 2008.
– Immersed in its maiden voyage, a 33-day route that will take it from Belfast to Dakar, the Odyssey has made its debut this Tuesday in Malaga with 150 passengers on board while waiting for more residents to join this floating community.
