The Supreme Court annuls the Government’s national registry of tourist rentals due to an infringement of regional powers: {Trans, summary}

Editor’s Note On Previous Article– Don’t expect the Sanchezistas to give up so easily:
– The administration may push back. However, the Government cannot simply appeal to a higher normal court. Its realistic options are:
– Ask the same court to clarify or reconsider limited aspects of the judgment, which rarely changes the outcome.
– Attempt a constitutional challenge before Constitutional Court of Spain, but only if it argues there is a constitutional issue involved, not merely disagreement with the legal interpretation.
– Rewrite the law or decree in a narrower form that respects regional powers and try again politically.
– Negotiate with autonomous communities to create a coordinated ‘shadow’ system voluntarily instead of imposing a fully centralised registry. They may offer increased funding in return for regional cooperation implementing such a system.
– The judgment itself already leaves part of the framework alive, specifically the digital information exchange system and national data coordination. That gives the Government a foundation to redesign the policy rather than starting from zero. So the most likely path is not a successful appeal overturning the ruling, but a revised version of the system crafted to survive future court scrutiny.

ALCAUCÍN

A breakdown leaves the areas of El Cerro and Venta Baja in Alcaucín without water supply following earlier restrictions due to contamination: {Trans}

National Police warns of the increase in cases of fraud linked to online accommodation reservations: {Trans, summary}
– The National Police has warned of a type of fraud linked to online accommodation reservations and has indicated that in the province of Malaga an increase in complaints related to this type of events has been detected. Through a note, officials assigned to the Cybercrime Group of the Provincial Judicial Police Brigade of Malaga have warned of the increase in complaints about this new scam, in which cybercriminals mainly send fraudulent messages via instant messaging.
– As explained by the Provincial Police Station, the scammers would use real reservation information –contact telephone numbers, confirmation numbers, dates or basic accommodation information – to contact users and request supposed pending payments or urgent verifications. Fraudulent messages sent by instant messaging platforms, and to a lesser extent by email or SMS, appear to come from the tourist establishment or the application that manages reservations used by customers. In them, the criminals request payment for the reservation, indicate that there is a problem with it, or with the validation, and request to enter the bank card information through a link.
– Researchers warn that these links often redirect to fake pages designed to steal financial information and recommend extreme caution in the event of any communication that requests bank details urgently.
– For this reason, they have launched a series of security recommendations, such as not providing bank card data through links received by message or email and verifying any incident by directly accessing the official application or page of the reservation platform. They also urge distrust of messages with an urgent or alarmist tone; to carefully check the web address before entering personal or banking information; to activate two-step verification whenever possible; and contact the bank immediately if financial information has been provided.
– The National Police have recalled that “no legitimate platform requests complete card data through links sent by instant messaging or SMS” and, if you have been a victim of this type of fraud, they recommend collecting screenshots, messages and proof of the payments made, to file the complaint, as soon as possible and providing the greatest amount of data. Another huge SAS medical negligence award: {Trans, summary}
– The Contentious-Administrative Section of the Court of Instance of Almería has judicially approved a compensation agreement of 140,000 euros within the framework of a property liability procedure followed against the Andalusian Health Service for a case of alleged medical negligence derived of a six-year delay in the diagnosis and monitoring of a kidney tumour.
– The case has its origins in 2016, when doctors detected a small tumour in his kidney during an appendicitis procedure. According to the complaining party, despite this finding, the patient was discharged without being adequately informed or referred for the corresponding follow-up by the specialist.
– Years later, in 2023, the tumour was detected again, with a considerably more serious evolution. This delay in care would have caused, according to the claim raised, the loss of the affected kidney, a condition of the vena cava and the need to undergo an oncological procedure whose outcome remains uncertain.
– As a consequence of these events, the patient’s defence initiated a claim for financial liability against the Andalusian Health Service, considering that there was abnormal functioning of the Health Administration due to the delay in the care, diagnosis and monitoring of the tumour.
– The lawyer warns that these types of situations are increasingly frequent in a context of high healthcare pressure in the public health system. “We are seeing other similar cases where delays in specialized care can lead to significant harm to patients. That is why it is essential not to let time pass and put yourself in the hands of professionals who can legally evaluate each case”, he points out.
– The lawyer, Jorge Guzmánalso, emphasizes that this matter highlights “the importance of complaining when relevant care delays occur, especially in those cases in which the patient is not treated by the specialist within the legally established deadlines”.
– The approved compensation in this case is 140,000 euros.

Spain misses deadline to adapt to the new European law against environmental crimes: {Trans, summary}
– May 21st marks the end of the two-year period for European Union member states to transpose the new Environmental Criminal Directive on combating environmental crimes across Europe. The environmental organization WWF reports that Spain has not yet completed the process.
– Laura Moreno, head of the WWF species program, points out in the statement that “it is very serious” that Spain is failing to meet the deadline for adapting to European regulations, “precisely the first obligation established by the directive.”
– The directive was approved in May 2024, but “Spain has not yet adapted its legislation,” WWF says in a statement, in which it asserts that the new European regulations “completely update the 2008 legal framework” and require countries to “toughen up” the prosecution of environmental crimes, “the third most lucrative criminal activity in the world,” the organization says.
