Editor’s Note to the hospitality sector: I am seeing many bars, cafes and venues now extending their hours and capacities in response to the end of the curfew. They should be aware the Junta de Andalucia is trying very hard to re-impose the curfew and the tighter capacity restrictions, despite the fact that as the law now stands it would again require a (new) National State of Emergency to do so. Sanchez has announced the national government is opposed to any new State of Alarm (see article in news section), which has the effect of encouraging those in hospitality to extend their hours. But it now happens that the national gov’t may be willing to let the Supreme Court decide if it grants autonomous communities their own curfew powers, despite the reservations of a few Cabinet Ministers. If the Junta de Andalucia gets their way, the old curfew & hospitality restrictions could return without much advance notice, causing chaos as upcoming events would need to be cancelled or have the event times changed or dates rescheduled, supply orders cancelled, tickets refunded, etc, etc. Autonomous communities would need approval from the National Supreme Court to impose curfews regionally, and that court has already announced it is inclined to allow the autonomous communities their own curfew powers. Being prepared for either case would be prudent.

Infections decrease and those hospitalized by Covid rise in Andalusia: {Translation} Updated: 10/05/2021, 16:45
-The evolution of the pandemic shows the same trend as last week with a slight decrease in the number of infections and deaths. The negative note is provided on Monday by the increase in the number of hospitalized patients after five days in which the number of Covid patients has been reduced and today there are 1,210, of which 332 are in ICU.
-Andalusia counts this Monday 1,354 new infections of coronavirus and six deaths. The figure is slightly higher than the 1,298 cases recorded on Saturday, but represents 352 fewer positives than those recorded a week ago, on Monday, May 3.
-The incidence rate starts this week at 181 cases (180.9) and continues to decline. Three provinces, Cadiz (93), Malaga (130) and Almeria (141) have 14-day incidence rates within the medium alert level, corroborated by the one-week rate. Only Granada remains at the extreme alert level with almost 350 infections per hundred thousand inhabitants at 14 days and 145 at one week.
-In hospitalizations, there has been a rise in the number of patients after five days of decreases. There are 1,210 Covid patients in hospitals, 61 more than on Sunday but 108 less than on the same day last week. Of the total 332 are in ICU, eleven more than Sunday and 14 less than seven days ago.
-This increase in the number of hospitalized patients has led, among other measures, to the Reina Sofia University Hospital in Cordoba to set up a new ICU module with six places for critical patients from Covid in two newly built operating rooms that were not active. Forty-five percent of the ICU patients in that hospital are Covid patients. Sánchez rules out legal changes and insists that communities have tools to face the pandemic: Pedro Sánchez rules out legal changes to face the final stretch of the COVID-19 pandemic after the lifting of the state of alarm, which has caused a wave of warnings from communities and political parties regarding the problems to face what remains ahead until vaccination is effective for the population as a whole. “The Government of Spain is clear that all the communities in this stadium have sufficient instruments to face the pandemic,” was the president’s response to these criticisms at a press conference in Athens.
The Government made a legislative modification last week through a decree law that will have to be validated in Congress so that the autonomous communities can appeal to the Supreme Court (for extending the curfews without a National State of Alarm), as has happened in Euskadi. The intention is that it dictates jurisprudence and the measures can be homogenized after the different interpretations that the judges have made. The 43-year-old Spanish national reportedly lived in a remote location in the mountains of Vélez-Málaga, and his modus operandi was to request an economic amount in advance from clients as management expenses, with no intention of carrying out the work, and has been arrested for seven crimes of fraud and misappropriation.
